These Terms and Conditions (“Terms”) apply to your use of the Primary Quiz website at www.primaryquiz.com (the “Site”) and to subscriptions and licences purchased for access to Primary Quiz.

Please read these Terms carefully before using the Site or purchasing access to Primary Quiz.

By creating an account, purchasing an Individual Subscription or School Licence, or otherwise using the Site, you agree to these Terms.

Nothing in these Terms affects any statutory rights that cannot legally be excluded or limited.

In these Terms, “Primary Quiz”, “we”, “us” and “our” refer to the business operating Primary Quiz and supplying the relevant subscription or licence.

Primary Quiz is part of the Education Crowd and Teach Active group of companies.

2. ABOUT THESE TERMS

These Terms apply to:

• visitors to the Site;

• registered users;

• purchasers and users of Individual Subscriptions; and

• schools and other organisations purchasing or using a School Licence.

Some provisions apply differently depending on whether you have an Individual Subscription or a School Licence. Those differences are explained below.

If a School Licence is purchased under a separate written quotation, order form, contract or agreement, that document will also apply. If there is a conflict between that document and these Terms concerning the commercial terms of the School Licence, the specific written agreement or order will take priority.

If you purchase on behalf of a school or other organisation, you confirm that you have authority to enter into the agreement on its behalf.

The following policies also apply to your use of Primary Quiz where relevant:

• our Privacy Notice;

• our Cookie Policy; and

• our Acceptable Use Policy.

Our Privacy Notice explains how and why we process personal information and the lawful bases on which we rely.

Our Cookie Policy explains the cookies and similar technologies used on the Site and the choices available to users.

 

4. ACCOUNTS

Some parts of Primary Quiz require you to create and use an account.

You must provide accurate and current information when creating an account and keep relevant account information up to date.

You are responsible for keeping your login details and password confidential.

You must not disclose your password or allow another person to use your account except where this is expressly permitted as part of a School Licence.

If you know or suspect that somebody else has obtained access to your account without permission, please contact us promptly at info@primaryquiz.com.

We may require you to reset your password or take other reasonable security measures where we believe an account may have been compromised.

 

5. TYPES OF PRIMARY QUIZ ACCESS

Primary Quiz may make some content available without payment.

Paid access is available through:

Individual Subscriptions – intended for one named teacher; and

School Licences – intended for schools and other educational organisations and allowing access by authorised users covered by the applicable licence.

There is currently no free trial for Individual Subscriptions.

 

6. INDIVIDUAL SUBSCRIPTIONS

An Individual Subscription is for one named teacher only.

It is personal to that subscriber and may not be transferred to another person.

An Individual Subscriber may use Primary Quiz and its resources with any classes that they personally teach during their active subscription.

Subject to these Terms, an Individual Subscriber may:

• access the resources included within their subscription;

• display those resources to classes they personally teach;

• download resources where the Site provides a download function;

• print resources for use with classes they personally teach; and

• adapt editable resources, such as editable Word documents, for their own teaching use.

An Individual Subscription does not provide a school-wide or departmental licence.

An Individual Subscriber must not:

• share their username or password with another teacher or other person;

• allow colleagues to use their account;

• provide colleagues with downloaded resources as a substitute for those colleagues obtaining their own authorised access;

• upload Primary Quiz resources to a shared school, trust or departmental resource bank unless the applicable School Licence permits this;

• systematically copy or distribute Primary Quiz resources to other members of staff;

• sell, sublicense or commercially redistribute Primary Quiz resources; or

• use an Individual Subscription as a substitute for a School Licence where access is required by multiple members of staff.

Where multiple teachers within the same school require access, each teacher must have their own Individual Subscription or the school must obtain an appropriate School Licence.

 

7. INDIVIDUAL SUBSCRIPTION PRICES

Primary Quiz currently offers the following Individual Subscription options:

 

Monthly Individual Subscription

£5 plus VAT per month (£6 including VAT).

The Monthly Individual Subscription automatically renews each month until cancelled in accordance with section 10.

 

Annual Individual Subscription

£45 plus VAT per year (£54 including VAT).

This is equivalent to £3.75 plus VAT (£4.50 including VAT) per month when calculated across the 12-month subscription period.

The Annual Individual Subscription lasts for 12 months.

The Annual Individual Subscription does not automatically renew.

At the end of the 12-month subscription period, access will end unless the subscriber actively purchases or agrees to a new subscription.

The price payable will be clearly displayed before an order is placed.

 

8. PAYMENT FOR INDIVIDUAL SUBSCRIPTIONS

Payments for Individual Subscriptions are processed on our behalf by Stripe, our third-party payment processor.

Your subscription contract is with Primary Quiz and not with Stripe.

Stripe may process payment and related information in accordance with its own terms and privacy information.

For a Monthly Individual Subscription, the applicable monthly subscription charge will be taken using the payment method provided when the subscription is purchased.

For an Annual Individual Subscription, the annual charge is taken when the subscription is purchased. No further annual payment will be taken automatically at the end of the 12-month period.

If a payment is declined, reversed or otherwise cannot be collected, we may contact you and may suspend paid access until payment has been successfully made.

 

9. AUTOMATIC RENEWAL OF MONTHLY INDIVIDUAL SUBSCRIPTIONS

Monthly Individual Subscriptions automatically renew each month unless cancelled.

Before purchase, we will make clear that:

• the subscription costs £6 per month including VAT;

• it renews automatically each month;

• the subscriber will be charged using their selected payment method; and

• the subscription continues until cancelled.

Each successful monthly payment provides access for the applicable monthly subscription period.

Subscribers may cancel in accordance with section 10.

 

10. CANCELLING A MONTHLY INDIVIDUAL SUBSCRIPTION

You may cancel the automatic renewal of your Monthly Individual Subscription by emailing:

You may give notice of cancellation at any time.

Unless you have a separate statutory right to an earlier cancellation or refund, cancelling your Monthly Individual Subscription will stop it from renewing for a further monthly period.

You will normally continue to have access to Primary Quiz until the end of the monthly subscription period for which you have already paid.

We will acknowledge your cancellation by email so that you have a record of the cancellation.

To avoid another monthly payment being taken, please send your cancellation request before your next renewal payment becomes due.

This section deals with stopping future automatic renewals. It is separate from any statutory cancellation rights you may have under section 12.

 

11. ANNUAL INDIVIDUAL SUBSCRIPTIONS

Annual Individual Subscriptions are purchased for a fixed period of 12 months.

They do not automatically renew.

At the end of the 12-month period, the subscription will expire and paid access will end unless the subscriber chooses to purchase a further subscription.

Where appropriate, we may contact Annual Individual Subscribers before their subscription expires to remind them that their access is approaching its end.

Any such reminder does not automatically renew the subscription or commit the subscriber to another payment.

 

12. STATUTORY CANCELLATION RIGHTS

If you purchase an Individual Subscription online and you are acting as a consumer for the purposes of applicable law, you may have statutory cancellation rights.

These rights are separate from your ability to stop the automatic renewal of a Monthly Individual Subscription.

Depending on the nature of the service and digital content supplied, the law may provide a 14-day cancellation period beginning when the contract is entered into.

Because Primary Quiz provides online access and may make digital resources available immediately after purchase, we may ask you during checkout to expressly request that access begins immediately.

Where digital content is supplied during a statutory cancellation period, we may also ask you to expressly consent to immediate supply and acknowledge the effect that this may have on your statutory cancellation rights, where permitted by law.

Where services begin during a statutory cancellation period at your express request and you subsequently exercise a statutory right to cancel, you may be required to pay an amount proportionate to the services supplied before cancellation, where the law permits this.

Nothing in these Terms is intended to remove or restrict any statutory cancellation or consumer rights that apply to you.

You should clearly state that you wish to cancel your contract and provide sufficient information for us to identify your subscription.

 

13. REFUNDS

Nothing in these Terms affects any statutory right you may have to a refund.

Outside those statutory rights, subscription payments are not normally refundable simply because a subscriber decides not to use Primary Quiz or no longer requires access during a subscription period.

Cancelling a Monthly Individual Subscription normally prevents the next monthly renewal rather than refunding the current monthly subscription period.

Annual Individual Subscriptions provide access for the 12-month period purchased and are not normally refundable after the applicable statutory cancellation period has ended, except where required by law or where we agree otherwise.

If we permanently withdraw a paid service during a period for which you have already paid, other than because of your breach of these Terms, we will consider an appropriate refund or other remedy having regard to the circumstances and your statutory rights.

 

14. SCHOOL LICENCES

A School Licence is intended for a school, academy, trust or other educational organisation rather than a single individual teacher.

A School Licence allows authorised users within the purchasing organisation to access and use Primary Quiz in accordance with:

• the School Licence purchased;

• any applicable quotation, order form or written agreement;

• these Terms; and

• any usage limits or conditions communicated as part of the purchase.

The number of authorised users, establishments or other permitted users covered by a School Licence will be determined by the particular licence purchased.

A School Licence must not be extended to staff, schools, organisations or other persons who are not covered by the applicable licence.

Schools are responsible for ensuring that users accessing Primary Quiz under their School Licence comply with these Terms.

 

15. SCHOOL LICENCE RENEWAL

Unless otherwise stated in the applicable quotation, order form or written agreement, School Licences may automatically renew at the end of their applicable subscription period.

The applicable subscription length, price, renewal arrangements, payment arrangements and cancellation provisions for a School Licence will be those communicated to the school when the licence is purchased or renewed.

Where a separate written agreement, quotation or order sets out specific renewal or cancellation terms, those terms will apply.

 

16. USE OF RESOURCES UNDER A SCHOOL LICENCE

Authorised users covered by a School Licence may use Primary Quiz resources for legitimate teaching and educational purposes within the scope of that licence.

Subject to the applicable licence, authorised users may:

• access resources through Primary Quiz;

• display resources to pupils;

• download resources where downloading is enabled;

• print resources for teaching purposes; and

• modify editable resources for teaching use within the licensed organisation.

A School Licence does not permit resources to be:

• sold or commercially redistributed;

• made publicly available online;

• provided to an unlicensed school or organisation;

• used to create a competing resource library or service;

• systematically extracted from Primary Quiz; or

• shared beyond the scope of the School Licence.

 

17. INTELLECTUAL PROPERTY RIGHTS

We are the owner or licensee of the intellectual property rights in the Site and in the material and resources published on it.

Those works are protected by copyright, trade mark and other intellectual property laws.

Purchasing a subscription or licence does not transfer ownership of any intellectual property rights to you.

Instead, we grant you a limited, non-exclusive and non-transferable right to use Primary Quiz and its resources in accordance with the Individual Subscription or School Licence you have purchased and these Terms.

Where a resource is provided in an editable format, such as Microsoft Word, you may modify that resource for permitted teaching purposes.

Except where expressly permitted by these Terms, you must not modify, reproduce, republish, sell, license, commercially exploit or distribute Primary Quiz resources without our prior written permission.

You must not remove copyright, trade mark or other proprietary notices from our materials.

 

18. SCRAPING, AUTOMATION AND PROHIBITED SOFTWARE

You must not use software, browser extensions, scripts, bots, automated tools or other technologies designed to:

• scrape or systematically extract content from Primary Quiz;

• bypass access controls;

• circumvent subscription or licensing restrictions;

• download resources in bulk where that functionality is not provided by us;

• interfere with the operation or security of the Site; or

• obtain unauthorised access to any part of the Site, server or associated systems.

You must not attempt to reverse engineer or otherwise misuse the Site except to the extent that such restriction is prohibited by law.

 

19. ACCEPTABLE USE

You may use Primary Quiz only for lawful purposes.

You must not use the Site:

• in breach of applicable law or regulation;

• fraudulently;

• to harm or attempt to harm another person;

• to transmit malicious software;

• to gain unauthorised access to systems or accounts;

• to infringe intellectual property rights; or

• in any way that materially interferes with the Site or another user's use of it.

Our Acceptable Use Policy may provide additional requirements.

 

20. PUPIL INFORMATION

Primary Quiz does not provide functionality for users to upload pupil information to the Site.

Users should not attempt to enter, upload or otherwise provide pupil names or other pupil personal information through areas of the Site that are not specifically designed for that purpose.

If we introduce functionality involving pupil personal information in the future, we will review and update our privacy information and applicable contractual terms before that functionality is made available.

 

21. AVAILABILITY OF PRIMARY QUIZ

We aim to keep Primary Quiz available and functioning reliably, but we cannot guarantee that the Site will always be available without interruption.

We may temporarily suspend or restrict access where reasonably necessary for:

• maintenance;

• security;

• technical improvements;

• emergency repairs;

• legal or regulatory requirements; or

• circumstances outside our reasonable control.

We will take reasonable steps to minimise disruption where practicable.

Nothing in this section limits any statutory rights or remedies that apply where a paid service is not supplied as required by law.

 

22. CHANGES TO PRIMARY QUIZ

We may update or change Primary Quiz from time to time, including to:

• improve the Site or resources;

• introduce new functionality;

• address security issues;

• comply with legal or regulatory requirements;

• reflect changes in technology; or

• update educational content.

We will not deliberately remove the essential benefit of an existing paid subscription without taking reasonable account of affected subscribers.

Where a change materially reduces the paid service during an existing subscription period, we will provide reasonable information about the change and any rights or remedies that may apply.

 

23. CHANGES TO PRICES

We may change subscription prices from time to time.

A price change will not retrospectively increase the price of a subscription period that has already been paid for.

For Monthly Individual Subscriptions, we will provide reasonable advance notice of a price increase before it affects a future renewal payment. You may cancel the subscription before the new price takes effect.

For Annual Individual Subscriptions, any new price will apply only if you choose to purchase a new annual subscription after your existing subscription expires.

School Licence prices will be dealt with in accordance with the applicable quotation, order, renewal communication or agreement.

 

24. SUSPENDING OR TERMINATING ACCESS

We may suspend or terminate an account where reasonably necessary because:

• payment has not been made;

• we reasonably suspect fraud or unauthorised access;

• the account has been shared in breach of these Terms;

• the user has materially or repeatedly breached these Terms;

• the Site or another user is at risk;

• our intellectual property is being misused; or

• we are required to do so by law.

Where appropriate, we will explain the reason for suspension or termination and give the user a reasonable opportunity to remedy a breach.

Immediate suspension or termination may be appropriate for serious breaches, fraud, security threats, deliberate unauthorised sharing or serious misuse of our intellectual property.

Where we permanently terminate paid access for reasons unrelated to a user's breach, we will consider any refund or other remedy required by law and, where appropriate, the unused part of the paid subscription period.

 

25. PRIVACY AND DATA PROTECTION

We process personal information in accordance with applicable data protection law and our Privacy Notice.

Our Privacy Notice explains, among other things:

• what personal information we collect;

• why we collect and use it;

• the lawful bases on which we rely;

• who we share information with;

• how long information is retained;

• the rights available to individuals; and

• how to contact us about privacy matters.

Not all processing of personal information is based on consent. Depending on the purpose, we may rely on another lawful basis permitted by data protection law.

 

26. COOKIES

Our Site uses cookies and similar technologies.

Further information is provided in our Cookie Policy.

Where consent is legally required for non-essential cookies or similar technologies, we will request that consent through the Site.

 

27. EDUCATIONAL CONTENT

Primary Quiz provides educational resources intended to support teaching and learning.

Although we take reasonable care when preparing resources, teachers and schools remain responsible for deciding whether particular materials are appropriate for their pupils, curriculum, teaching objectives and circumstances.

Nothing in this section excludes any statutory rights relating to digital content or services.

 

28. OUR RESPONSIBILITY TO INDIVIDUAL USERS

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so.

This includes liability for:

• death or personal injury caused by our negligence;

• fraud or fraudulent misrepresentation; or

• any other liability that cannot legally be excluded or limited.

Where you are entitled to consumer protection under applicable law, nothing in these Terms is intended to exclude or restrict those rights.

Subject to those protections, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was entered into.

The fact that an Individual Subscriber uses Primary Quiz in connection with teaching does not remove any statutory rights that apply to that subscriber under applicable law.

 

29. OUR RESPONSIBILITY TO SCHOOLS AND BUSINESS USERS

This section applies where the contracting customer is a school, academy, trust, company or other organisation acting for business or professional purposes.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

Subject to that, and to the maximum extent permitted by law, we will not be liable to a business or organisational user for:

• loss of profits;

• loss of sales or revenue;

• loss of business;

• loss of anticipated savings;

• loss of business opportunity;

• loss of goodwill; or

• indirect or consequential loss.

Any specific liability provisions contained in a separate School Licence agreement will apply where relevant.

 

30. VIRUSES AND SECURITY

We take reasonable steps to operate the Site securely but cannot guarantee that the Site will always be completely secure or free from bugs or viruses.

You are responsible for using appropriate security, antivirus and device protection.

You must not knowingly introduce viruses, malware, trojans, worms, logic bombs or other harmful material.

You must not attempt to gain unauthorised access to the Site, the server on which it is hosted or any connected system.

 

31. THIRD-PARTY WEBSITES AND SERVICES

The Site may contain links to third-party websites, resources or services.

These links are provided for information or convenience only.

We do not control third-party websites and are not responsible for their content, availability or privacy practices.

Where third-party services are used to support Primary Quiz, such as payment processing, their own terms or privacy information may also apply to their processing or services.

 

32. LINKING TO PRIMARY QUIZ

You may link to publicly accessible pages on the Site in a fair and lawful manner that does not damage our reputation or suggest an association, approval or endorsement where none exists.

You must not frame the Site on another website or link directly to paid resources in a way that bypasses our access controls.

We may withdraw linking permission where reasonably necessary.

 

33. CHANGES TO THESE TERMS

We may update these Terms from time to time.

Changes may be made to reflect:

• changes in law or regulation;

• changes to Primary Quiz;

• security requirements;

• changes to payment or technical systems; or

• improvements or clarifications to these Terms.

The Terms displayed at the time of a new purchase will apply to that purchase, subject to applicable law.

Where we propose a material change affecting an existing paid subscription, we will provide reasonable notice where required and will not rely on these Terms to make a change that would be unfair or unlawful.

 

34. COMMUNICATIONS

We may contact subscribers and schools with communications that are reasonably necessary to operate their account or subscription, including:

• payment confirmations;

• renewal information;

• cancellation confirmations;

• security notices;

• important service information; and

• changes to applicable terms.

Service communications are different from marketing communications.

Where required by law, marketing communications will be sent only where we have an appropriate lawful basis and recipients will be given an appropriate way to unsubscribe.

We will aim to investigate complaints fairly and respond within a reasonable period.

Nothing in this complaints procedure affects any statutory rights or remedies available to you.

 

36. TRANSFERRING OUR AGREEMENT

We may transfer our rights and obligations under these Terms to another organisation, for example as part of a restructuring, sale or transfer of the Primary Quiz business.

We will take reasonable steps to ensure that such a transfer does not materially reduce the rights of existing subscribers and will notify affected customers where required.

You may not transfer an Individual Subscription to another person without our written agreement.

Rights under a School Licence may only be transferred where permitted by the applicable licence or with our written agreement.

 

37. SEVERABILITY

Each provision of these Terms operates separately.

If a court or relevant authority decides that any provision is unlawful or unenforceable, the remaining provisions will continue in effect.

 

38. DELAY IN ENFORCING THESE TERMS

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

 

39. GOVERNING LAW AND JURISDICTION

If you are a consumer, these Terms are governed by the laws of England and Wales, without depriving you of any mandatory protections that apply under the law of the part of the United Kingdom in which you live.

If you live in Scotland, you may generally bring proceedings in the Scottish or English and Welsh courts.

If you live in Northern Ireland, you may generally bring proceedings in the Northern Irish or English and Welsh courts.

If you live in England or Wales, proceedings may generally be brought in the courts of England and Wales.

If you are a school, company or other business or organisational customer, these Terms and any dispute or claim arising from them are governed by the laws of England and Wales and, unless otherwise agreed in writing, the courts of England and Wales will have exclusive jurisdiction.
